Netflix Merger Litigation

Pak Heinz is proud to have successfully challenged Netflix’s planned acquisition of Warner Bros. Discovery, including its streaming service HBO Max.  Pak Heinz challenged that planned acquisition in federal court, state court, and arbitration on behalf of Netflix subscribers who faced the prospect of higher prices and reduced choice from Netflix’s absorbing HBO Max into its already-dominant streaming service.  After Pak Heinz filed those cases in February 2026, Netflix declined to match Paramount’s bid for Warner Bros. Discovery, abandoned its acquisition plans, and terminated the process required to obtain U.S. antitrust clearance of the acquisition.  Having quickly achieved the relief they sought, our clients voluntarily dismissed their lawsuits without prejudice, with full assurance that Netflix can no longer proceed with its abandoned attempt to acquire Warner Bros. Discovery.
